Terms of Service

These terms govern your use of the Cadent app. Cadent is provided by Jack Leeming ("we", "us", "our"). By creating an account or using the app, you agree to these terms. If you do not agree to them, do not use Cadent.

The service

Cadent imports workout data from Apple Health on iPhone or Health Connect on Android, stores it in your account, and allows you to set and track long-term fitness goals. It requires an iPhone or an Android phone, a source of workout data that writes to Apple Health or Health Connect, and a Cadent account.

We may add, change or remove features. Where we remove a significant feature, we will note it in the app's release notes.

Your account

Health and medical disclaimer

Cadent is a fitness tracking app. It is not a medical device and does not provide medical advice. It is not intended to diagnose, treat, cure or prevent any disease or medical condition. No information presented in the app, including heart rate, energy burned, pace, goals or badges, constitutes medical advice or should be relied upon for any medical purpose.

Physical exercise involves risk of injury. You should consult a doctor or other qualified health professional before beginning or significantly changing an exercise programme, particularly if you have an existing medical condition. If you experience pain, dizziness or discomfort while exercising, stop and seek medical attention. Do not disregard professional medical advice, or delay seeking it, because of anything shown in Cadent.

You use the app, and undertake any physical activity it records, at your own risk.

Accuracy of information

Cadent displays data recorded by your own devices and the apps that write to Apple Health or Health Connect. It does not measure anything itself. The accuracy of any figure depends on the device or app that produced it, and figures may be incomplete or incorrect.

Cadent is designed to display only values that were actually recorded, rather than estimating missing figures, but we make no warranty that any figure is accurate.

Acceptable use

You must not use Cadent for any unlawful purpose or in any way that harms another person; attempt to access another user's data or any part of our systems you have not been granted access to; interfere with, disrupt or place unreasonable load on the service; or copy, resell, sublicense or redistribute the app, or reverse engineer it except to the extent that applicable law expressly permits.

We may suspend or terminate access where these terms are breached.

Your content

Your workout and goal data remains yours. You grant us only the permission required to store that data and make it available to you on your devices. We do not claim ownership of it, and we do not sell it or use it to train machine learning systems.

Our handling of your personal data is described in the Privacy Policy, which forms part of these terms.

You can export your workout history as a spreadsheet from within the app. We recommend keeping your own copy of any data that is important to you.

Intellectual property

The Cadent app, its name, design and content are owned by us and are protected by intellectual property law. These terms grant you a limited, personal, non-transferable and revocable licence to use the app for your own personal, non-commercial purposes.

Map data is provided by OpenStreetMap contributors and made available through OpenMapTiles and OpenFreeMap, used under the terms of the Open Database Licence. Attribution is shown in the app's Settings screen.

Availability

The app is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error free, or available at any particular time. The app depends on services we do not control, including Apple Health, Health Connect and our hosting and map providers, and those services may fail or change.

We may suspend the service for maintenance, and we may discontinue it. If we discontinue the service, we will give reasonable notice so that you can export your data.

Price

Cadent is currently provided free of charge. If we introduce paid features, we will make the price and what it covers clear before any charge is made, and features you already have will not become chargeable without your agreement.

Termination

You may stop using Cadent at any time and may delete your account from the Settings screen. Deleting your account removes your data as described in the Privacy Policy.

We may suspend or close an account that breaches these terms, or where we are required to do so by law. Where it is reasonable to do so, we will give notice first.

Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above, we are not liable for indirect or consequential loss, for loss of data where you have not maintained your own export, or for any decision you take on the basis of information displayed in the app. Our total liability to you in connection with the app is limited to the amount you have paid to use it.

If you are a consumer, these terms do not affect your statutory rights.

Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last changed, and significant changes will be noted in the app's release notes. If you continue to use Cadent after a change takes effect, you accept the updated terms.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, you retain the benefit of any mandatory protections given by the law of the country in which you live.
